The Joint Money Laundering Steering Group Limited is a company limited by guarantee with company number 04729266 whose registered office is at 5th Floor, 1 Angel Court, London EC2R 7HJ (“JMLSG”).

General

By accessing any part of JMLSG’s website (the “Site”), which includes documents downloaded from the Site, users accept and agree to be bound by the following terms and conditions (the “Terms”). These Terms shall be governed by and interpreted in accordance with English law and shall apply to the entirety of the Site as well as any current or historic JMLSG guidance (“Guidance”) and any information contained therein.

Intellectual Property

A) The Site

Persons using the Site acknowledge that, except where expressly varied or otherwise stated, all intellectual property rights associated with the Site (including, without limitation, all copyright) are vested in JMLSG.

Users may copy or make hard copies of selected portions of the Site (but not the whole Site), provided copies are made (i) for their personal use, or (ii) subject to any specific restrictions, for legitimate and legal internal business purposes, provided in all cases that any legal notices, disclaimers, copyright notices, trademark legends or other proprietary rights notices are not removed. The Site and any information contained on the Site may not otherwise be republished, reproduced, distributed or transmitted to any other person or posted on any public website or alerter service. Users may not modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit the Site, in whole or in part.

B) The Guidance

Any intellectual property rights in the Guidance are owned exclusively by JMLSG. Users may download or make hard copies of all or parts of the Guidance for personal use or for legitimate and legal internal business purposes, but such downloads or hard copies may not be distributed to third parties, sold or otherwise circulated for profit. Any legal notices, disclaimers, copyright notices, trademark legends or other proprietary rights notices may not be removed. The Guidance may not otherwise be republished, reproduced, distributed or transmitted to any other person or posted on any public website or alerter service. Users may not modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit the Guidance, in whole or in part.

Use of Guidance and Disclaimer

Users of the Site and the Guidance acknowledge that JMLSG has produced Guidance to assist in explaining the requirements of and give practical advice on compliance with, UK anti money laundering and counter terrorist financing legislation, the regulations prescribed pursuant to such legislation, and any relevant FCA rules.  The Guidance is addressed to firms in the industry sectors represented by JMLSG’s member bodies and to those firms regulated by the FCA. Parts of the Guidance have received HM Treasury approval(1), and the courts and the FCA are required to take account of the Guidance, and whether a person or firm has followed the Guidance, under certain circumstances(2). However, users should note that the Guidance is not itself law or regulation, and is not legally binding. Following the Guidance does not guarantee that persons and firms can avoid all or any liability.

JMLSG Guidance does not supplant the Proceeds of Crime Act 2002, The Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017, other relevant legislation, FCA rules or guidance, or relevant case law. Firms should ensure that they understand and comply with all relevant legislation, regulations and requirements.  Any information provided by JMLSG on the Site or in the Guidance does not constitute legal, regulatory, financial or other professional advice, or advice of any sort, and may not be relied upon. The Guidance should never be treated as a substitute for specific advice relevant to particular circumstances. Users should therefore consider all relevant legal, accounting and regulatory issues before using the Guidance and, if appropriate, consult their professional advisers.

To the extent permitted by applicable law, neither the JMLSG nor any of its directors, officers or members accepts:

  • any duty of care to any person in relation to the Guidance or any other content on the Site;
  • responsibility or liability under any circumstances as to the accuracy or completeness of the Guidance or any information contained on the Site, or for any use to which the Guidance or content on its Site may be put; or
